La custodia de los hijos se utiliza para determinar el estado de la relación entre los padres y su hijo. El padre (o los padres) a quien se le otorga la custodia tiene el derecho legal de tomar decisiones en nombre del hijo, así como la responsabilidad de cuidar de él (ella). En los casos en que los padres se divorcian, no están casados o no viven juntos, los tribunales tienen dos tipos de custodia que pueden determinar: custodia legal y custodia física. ¿Cómo se determina la custodia de los hijos en Denver?

Los otros factores prominentes que se consideran en la determinación de la custodia son:

  • Los estilos de crianza (son alentadores, amorosos y solidarios)

En Colorado, los jueces prefieren otorgar a los padres la custodia compartida. Esto les da a ambos padres suficiente tiempo y contacto con su hijo y minimiza cualquier alteración en la rutina y estilo de vida normal del hijo. Sin embargo, el tribunal no otorgará la custodia compartida a un padre que se considere “no apto” o se considere un riesgo para el bienestar físico y emocional del hijo. Tales juicios generalmente se dan en casos en los que uno de los padres tiene antecedentes de violencia, abuso, negligencia, dependencia del alcohol o las drogas, o antecedentes penales.

Tipos de Custodia de los Hijos en Colorado

Cuando el tribunal discute asuntos de custodia legal exclusiva, se refiere a uno de los padres, la única persona que tiene la autoridad para tomar decisiones legales en nombre de su hijo.
