Filing for a Divorce in Englewood

Filing for a divorce can be a complex process and one that varies slightly depending on whether a couple has children or not. If you do not have children with your spouse, the simplified version of the process for divorce looks like the following–

  1. Meet the residency requirements – you or your spouse must have lived in the state for at least 90 days prior to filing for divorce;
  2. Determine whether or not you and your spouse will file for divorce together or separately.
    1. If you’re filing on your own, you’ll need to file the petition for dissolution of marriage, file the forms with the court, and then arrange to have your spouse served with the divorce papers.
  3. Resolve issues in a divorce – if you filed separately and had your spouse served with papers, you’ll need to wait for them to respond. If they are not in agreement about how the divorce should be settled, you’ll need to resolve issues before the divorce can proceed. If mediation fails, then you may need to litigate the divorce.

If you have children, the divorce process looks different. Mainly, you and your spouse will need to file a parenting plan with the court in order for the divorce to be finalized. If you have questions about this process, one of our attorneys can help.

Contested vs. Uncontested Divorce

There are two types of divorce in Colorado: contested and uncontested. In an uncontested divorce, both parties are in agreement about what the divorce settlement should look like–there is no disagreement about how property and debts should be divided, whether or not spousal maintenance (alimony) should be part of the divorce settlement, what the parenting arrangement will look like, etc. This type of divorce is quick and simple. 

A contested divorce, on the other hand, means that parties are not in agreement about how the above issues should be resolved. As such, there may be high levels of contention surrounding where children should live, how property should be divided, who will pay for certain debts, and whether or not one spouse should receive alimony. As mentioned above, when a divorce is contested and issues cannot be resolved through mediation, a couple will need to litigate the divorce. Litigation is expensive, time-consuming, and often very emotional. And of course, there’s no guaranteed outcome. As such, our law firm strongly recommends that couples attempt to work together to resolve disagreements out of court whenever possible.
